By accessing and using Best AI Scraper services provided by samko labs, s.r.o., you represent that you are acting in a professional capacity and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

You represent and warrant that you have the authority to enter into this agreement on behalf of yourself or the organization you represent, and that you will use the service solely for legitimate business purposes.

2. Service Description

Best AI Scraper provides AI-powered web scraping and data extraction services. Our services include:

• Web scraping and data extraction tools
• AI-powered data processing and analysis
• API access for automated data collection
• Credit-based usage system

3. Free Trial and Billing

We offer a free trial of 1000 credits to new users. Our billing system operates on a credit-based model where different actions consume varying amounts of credits.

All payments are processed by Polar.sh, who serves as our Merchant of Record (MOR). All billing inquiries, disputes, and payment-related issues should be directed to Polar.sh.

4. Customer Responsibility and Legal Compliance

samko labs, s.r.o. is a technology provider only. We provide scraping tools but do not advise on, approve, or authorize any specific scraping activities. You are entirely responsible for:

• Legal compliance: Ensuring all scraping activities comply with applicable laws in your jurisdiction and the target website's jurisdiction
• Permission verification: Obtaining explicit permission from website owners where required
• Terms of service compliance: Reading and complying with each target website's terms of service and robots.txt
• Data protection compliance: Ensuring compliance with GDPR, CCPA, and all applicable data protection regulations
• Intellectual property respect: Ensuring you do not infringe copyrights, database rights, or other IP
• Rate limiting: Implementing appropriate delays and not overwhelming target servers
• Personal data handling: Obtaining proper consent for any personal data collection

You agree not to use our services to:

• Scrape any website without proper legal authorization
• Violate any website's terms of service or robots.txt
• Collect personal data without lawful basis and consent
• Engage in any illegal or unauthorized data collection
• Infringe on any intellectual property rights
• Overwhelm servers or engage in abusive scraping practices

5. Limitation of Liability

LIABILITY ONLY FOR PROVEN FAULT: samko labs, s.r.o. shall only be liable for damages if our proven fault or negligence directly caused the damage. The burden of proving our fault lies entirely with you.

MONETARY CAP: Even if our fault is proven, our total liability to you shall not exceed fifty percent (50%) of the total fees you paid to us in the six (6) months immediately preceding the event giving rise to the claim.

EXCLUDED DAMAGES: Under no circumstances shall we be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, business opportunities, or goodwill
• Data loss or corruption (including scraped data)
• Business interruption or downtime
• Third-party claims related to your scraping activities
• Regulatory fines or penalties imposed on you
• Any damages exceeding the monetary cap above

NO CONTROL DISCLAIMER: We have no control over, and are not responsible for: (i) the content, accuracy, or legality of websites you choose to scrape; (ii) your scraping configurations or target selections; (iii) your compliance with applicable laws; or (iv) actions taken by website owners or third parties.

6. Indemnification

COMPREHENSIVE INDEMNIFICATION - You will fully indemnify us against ALL third-party claims including:

• Website owner claims: Any legal action by owners of scraped websites
• Intellectual property claims: Copyright, database rights, trademark infringement
• Terms of service violations: Breach of target website ToS or robots.txt
• Data protection violations: GDPR, CCPA, and other privacy law violations
• Regulatory actions: Government fines, penalties, or enforcement actions
• Unauthorized access claims: Computer fraud, hacking, or trespass allegations
• Competition law violations: Unfair competition or anti-competitive practices
• Contractual breaches: Any breach of these terms or applicable laws
• Consequential damages: Business losses claimed by third parties

7. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted service. We may suspend or terminate services for maintenance, security reasons, or violation of these terms.

8. Intellectual Property

The service, including all software, documentation, and related materials, is the property of samko labs, s.r.o. and is protected by intellectual property laws. Data you extract using our service remains your property, subject to applicable third-party rights.

9. Termination

We may terminate or suspend your account and access to the service at our sole discretion, without prior notice, for violation of these terms or any other reason.

10. Governing Law

These terms are governed by the laws of Slovakia. Any disputes shall be resolved in the courts of Slovakia.
